STATEMENT OF JURISDICTION

          This is an appeal from a final judgment of a United States District Court. That judgment disposed of all claims of all parties.  Jurisdiction in this court is based on 28 U.S.C. §1291.

    The case presents claims under the federal and Florida Constitutions and the Fair Housing Act, as amended, (“FHAA”); 42 U.S.C. §§ 360.1 et seq.; the Americans with Disabilities Act (“ADA”), 42 U.S.C. §§.1210.1 et seq.; the Equal Protection clauses of the federal and Florida Constitutions; and the Due Process clauses of the federal and Florida Constitutions, all arising out of the same nucleus of operative fact. Plaintiffs filed the case in a Florida state court, and the City of Delray Beach (“City”) removed to federal court, as authorized by 28 U.S.C. §1441 (a) and (b).  R-1  Jurisdiction in the district court was based on 28 U.S.C. §1331 (federal question), 28 U.S.C. §1343(constitutional claim) and 28 U.S.C. §1367 (1994) (pendent state claims).

      Judgment was entered on the docket on September 6, 2000. R-58. Notice of appeal was timely filed by all plaintiffs on October 2, 2000. R-60
